This notice describes how medical information about you maybe used and disclosed and how you can get access to this information. Please review it carefully.

I. Our Commitment to Your Privacy

Lemonade Mental Health,PLLC (“we,” “our,” or “the Practice”) is dedicated to protecting your ProtectedHealth Information (PHI). PHI includes any information that identifies you andrelates to your past, present, or future mental or physical health, the healthcare services you receive, or payment for those services.

‍We are required by law to:
‍●     Maintain the privacy and security of your PHI.
●     Provide you with this notice of our legal duties and privacy practices.
●     Abide by the terms of the notice currently ineffect.
●     Notify youpromptly if a breach occurs that may have compromised the privacy or security of your information.

II. How We Use and Disclose Your Information

We typically use or share your health information in the following ways:

‍1. Routine Clinical & Business Uses

‍●     For Treatment: We use your PHI toprovide care and may share it with other professionals treating you (e.g.,coordinating with your primary care physician).
●     For Healthcare Operations: We use your PHI to run our practice, improve your care, and conduct quality assessments or business planning.
●     For Payment: We share your PHI to bill and receive payment from health plans or other entities.
●     BusinessAssociates: We work with trusted HIPAA-compliant partners (our EHR systemand phone line system) who are legally contracted to protect your data with the same level of care we do.

‍2. Legal and Safety Disclosures (No Authorization Needed)

‍We may share yourinformation without your permission in these specific situations:

● Public Safety: To prevent a serious threat to your health or safety or the safety of others.
- ○     Preventing disease
  ○     Helping with productrecalls
  ○     Reporting adverse reactions to medications
● Mandated Reporting: To report suspected abuse, neglect, or domestic violence as required by Massachusetts law.
● Legal Proceedings: In response to a court order, administrative order, or valid subpoena.
- ○ SUD Records:
- - ■ To the extent that we have your substance use disorder patient records, subject to 42 CFR part 2, we will not share that information for investigations or legal proceedings against you without (1) your written consent or (2) a court order and a subpoena.
    ■ If we have your substance usedisorder patient records, subject to 42 CFR part 2, we will give you clear and obvious notice in advance and a choice about whether to receive fundraising communications that use your Part 2 information.
●     Workers’ Compensation: For workers' compensation claims or similar programs.
●     Research: To perform research.
●     Donations: To respond to organ andtissue donation requests.
●     End of Life: To work with a medical examiner or funeral director.

3. Uses Requiring Your Written Authorization

‍We will never share your information for the following without your explicit written permission:
●     Marketing purposes or the sale of your PHI.
●     Most sharing of psychotherapy notes.
●     Note: You may revoke any authorization at any time by notifying us in writing.

III. YourRights Regarding Your Information

● Access Your Records:
- ○ You can ask to see your medical records. Ask us how to do this.
  ○ You can request an electronic or paper copy ofyour medical and billing records. We provide these within 30 days (areasonable, cost-based fee may apply).

●     Request Corrections: You can ask us to correct records you believe are inaccurate. We may say "no," but we will explain why in writing within 60 days.
●     Confidential Communications: You can ask us to contact you in a specific way (e.g., home phone vs. cell) or at a differentaddress. We will honor all reasonable requests.
●     Request Restrictions: You can ask us not to use or share certain information for treatment, payment, or operations. We are not required to agree to your request, and we may say “no,” for example, if it could affect your care. If we agree to your request, we may still share this information in the event that you need emergency treatment. If you pay for a service out-of-pocket in full, we will honor your request not to share that information with your insurer.

● Accounting of Disclosures: You can request a list of the times we’ve shared your info for six years prior to your request, including who we shared it with and why.
- ○ We will include all the disclosures exceptfor those about treatment, payment, and health care operations, and certainother disclosures (such as any you asked us to make). We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if youask for another one within 12 months.

● Choose a Representative:
- ○ If someone has authority to act as your personal representative, such as if someone has a medical power of attorney or is your legal guardian, they can exercise your rights on your behalf.
  ○ We will make sure the person has this authority and can act for you before we take any action.

IV. Special Protections & Digital Privacy

●     Telehealth Security: While we use encrypted, HIPAA-compliant platforms for video sessions, the use of electroniccommunication carries inherent risks. By engaging in telehealth, you agree to use our designated secure platforms for clinical discussions.

●      MassachusettsState Protections: Based on these protections, we apply stricter confidentiality standards to HIV/AIDS status, genetic information, and specific communications between social workers/psychotherapists and clients.

●      Social Media: To maintain professional boundaries and your privacy, our clinicians do not accept "friend" or "contact" requests from clients on personal social media.

V. Complaints and Contact Information

If you believe your privacy rights have been violated, you may contact our Privacy Officer using the information on page 1.

You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting https://www.hhs.gov/hipaa/filing-a-complaint/index.html.

‍We will not retaliate against you for filing a complaint.‍

VI. Date and Terms

‍Effective Date: April 5, 2026

Changes to the Terms of This Notice: We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our office, and on our web site (www.lemonadementalhealth.com).
